Know Your Rights: Disability Rights
There are various laws and regulations designed to protect your rights and ensure equal access when you or a loved one is diagnosed with triple negative breast cancer (TNBC).
Americans with Disabilities Act (ADA):
The ADA prohibits discrimination against individuals with disabilities in employment, public accommodations, transportation, and state and local government services. Breast cancer can be considered a disability under the ADA if it substantially limits one or more major life activities.
Reasonable Accommodations:
Employers covered under the ADA are required to provide reasonable accommodations to employees with disabilities, including those undergoing treatment for breast cancer. This might include modified work schedules, adjustments to job duties, or time off for medical appointments or recovery.
Family and Medical Leave Act (FMLA):
The FMLA provides eligible employees with up to 12 weeks of unpaid leave per year if themselves or a family member is in treatment or recovery from a serious health condition such as breast cancer. It guarantees job protection during the leave period.
Health Insurance Portability and Accountability Act (HIPAA):
HIPAA ensures privacy and confidentiality of medical information, including breast cancer diagnosis and treatment records. It gives you control over who can access your health information.
Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI):
Individuals unable to work due to breast cancer may qualify for SSDI or SSI benefits, depending on their work history, income, and severity of their condition. These programs provide financial assistance to individuals with disabilities.
Educational Rights:
Under the Individuals with Disabilities Education Act (IDEA) and Section 504 of the Rehabilitation Act, students with breast cancer are entitled to accommodations and support services in educational settings to ensure they can participate fully and receive necessary medical care.
Access to Healthcare and Support Services:
Individuals with breast cancer have the right to access appropriate medical care, including cancer treatment, rehabilitation services, and support groups. They are also protected from discrimination based on their health condition.

Understanding your rights can equip you to advocate for yourself and ensure you receive the accommodations and support necessary to maintain your quality of life during and after treatment. Talk to your oncology social worker or patient/nurse navigator to help you better understand what benefits are available to you based on your specific diagnosis and treatment plan.
